This Privacy Policy describes how Laesera (the ‘Site’, ‘we’, ‘us’ or ‘our’) collects, uses and discloses your personal information when you visit our Site, use our services or make a purchase at laesera.com (the ‘Site’) or otherwise communicate with us about the Site (together, the ‘Services’). For the purposes of this Privacy Policy, ‘you’ and ‘your’ refer to you as a user of the Services, whether you are a customer, a website visitor or another individual whose information we have collected under this Privacy Policy.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal or regulatory reasons. We will post the updated Privacy Policy on the Site, update the ‘Last updated’ date and take any other steps required by applicable law.

How we collect and use your personal information

In order to provide the Services, we collect personal information about you from a range of sources, as set out below. The information we collect and use depends on how you interact with us.

In addition to the specific uses set out below, we may use the information we collect about you to communicate with you, to provide or improve the Services, to comply with any applicable legal obligations, to enforce any applicable terms of service, and to protect or defend the Services, our rights and the rights of our users or others.

What personal information we collect

The type of personal information we obtain about you depends on how you interact with our Site and use our Services. When we use the term ‘personal information’, we mean information that identifies you, relates to you, describes you or can be associated with you. Information we collect directly from you

How we use your personal information

Provision of products and services. We use your personal information to provide the Services to you under the agreement we have with you, including processing your payments, fulfilling your orders, sending notifications relating to your account, purchases, returns, exchanges or other transactions, creating, maintaining and otherwise managing your account, arranging shipping, facilitating returns and exchanges, and other features and functionality relating to your account. We may also improve your shopping experience by enabling Shopify to match your account with other Shopify services you may wish to use. In that case Shopify processes your data as set out in its Privacy Policy and Consumer Privacy Policy.

Marketing and advertising. We may use your personal information for marketing and promotional purposes, such as sending marketing, advertising and promotional communications by email, text message or post, and showing you advertisements for products or services. This may involve using your personal information to better tailor the Services and advertising on our Site and other websites. If you are a resident of the EEA, the legal basis for these processing activities is our legitimate interest in selling our products, under Article 6(1)(f) GDPR.

Security and fraud prevention. We use your personal information to detect, investigate or take action on possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We strongly recommend that you do not share your username, password or other access details with anyone. If you believe your account has been compromised, please contact us immediately. If you are a resident of the EEA, the legal basis for these processing activities is our legitimate interest in keeping our website secure for you and other customers, under Article 6(1)(f) GDPR.

Communication and service improvement. We use your personal information to provide you with customer support and to improve our Services. This is in our legitimate interest in communicating with you, providing you with effective services and maintaining our business relationship with you, under Article 6(1)(f) GDPR.

Like many other websites, we use Cookies on our Site. Specific information about the Cookies we use in connection with running our store on Shopify can be found at https://www.shopify.com/legal/cookies. We use Cookies to support and improve our Site and our Services (including to remember your actions and preferences), to carry out analytics and to better understand user interaction with the Services (in our legitimate interest in administering, improving and optimising the Services). We may also allow third parties and service providers to use cookies on our Site to better tailor the services, products and advertising on our Site and other websites.

Most browsers accept Cookies automatically by default, but you can set your browser to delete or refuse cookies in its settings. Third-party websites and links

Our Site may contain links to websites or other online platforms operated by third parties. If you follow links to sites that are not affiliated with or controlled by us, it is important that you read their privacy and security policies and other terms. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness or reliability of the information on them. Information you provide in public or semi-public locations, including information you share on third-party social networks, may also be visible to other users of the Services and/or users of those third-party platforms, without restriction as to its use by us or by any third party. The inclusion of such links on our Site does not in itself imply endorsement of the content on those platforms or of their owners or operators, except as stated in the Services.

Children’s data

The Services are not intended for use by children and we do not knowingly collect personal information about children. If you are the parent or guardian of a child who has provided us with personal information, you can contact us using the contact details below to request its deletion.

As at the effective date of this Privacy Policy, we do not have actual knowledge that we ‘share’ or ‘sell’ personal information of individuals under 16 years of age (as those terms are defined under applicable law).

Security and retention of your information

Please note that no security measure is perfect or impenetrable, and we cannot guarantee ‘perfect security’. In addition, information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on a range of factors, such as whether we need the information to maintain your account, to provide the Services, to comply with legal obligations, to resolve disputes or to comply with other applicable contracts and policies.

Your rights

Depending on where you live, you may have some or all of the rights set out below in relation to your personal information. These rights are not absolute, however, and may only apply in certain circumstances; in certain cases we may decline your request, to the extent permitted by law.

• Right of access / right to know: you may have the right to request access to the personal information we hold about you, including details of how we use and share your information.
• Right to erasure: you may have the right to request that we delete the personal information we hold about you.
• Right to rectification: you may have the right to request that we correct inaccurate personal information we hold about you.
• Right to portability: in certain circumstances and subject to certain exceptions, you may have the right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party.
• Right to opt out of the sale or sharing of personal information or of targeted advertising: you may have the right to ask us not to ‘sell’ or ‘share’ your personal information, or to opt out of the processing of your personal information for purposes considered ‘targeted advertising’ as defined under applicable privacy law. Please note that if you visit our Site with the Global Privacy Control opt-out preference signal enabled, we will, depending on where you are located, automatically treat this as a request to opt out of the ‘sale’ or ‘sharing’ of information for the device and browser you use to visit the Site.

• Withdrawal of consent: where we rely on your consent to process your personal information, you may have the right to withdraw that consent.

If you opt out, we may still send you non-promotional emails, such as emails about your account or orders you have placed.

We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address or account details, before providing a substantive response to your request. In accordance with applicable law, you may appoint an authorised agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require the agent to provide proof of authorisation to act on your behalf, and we may ask you to verify your identity directly with us. We will respond to your request in good time, as required under applicable law.

If you have complaints about how we process your personal information, you can contact us using the contact details below. If you are not satisfied with our response to your complaint, depending on where you live you have the right to appeal our decision by contacting us using the contact details below, or to lodge your complaint with your local data protection authority. International users

Please note that we may transfer, store and process your personal information outside the country in which you live. Your personal information is also processed by staff and external service providers and partners in those countries.

Where we transfer your personal information outside Europe, we rely on recognised transfer mechanisms such as the European Commission’s standard contractual clauses, or equivalent contracts issued by the relevant competent authority of the United Kingdom where relevant, unless the data is transferred to a country that has been found to provide an adequate level of protection.
